Plan along the Ostružnica railway line in the water source area

Detailed regulation plan space between the ring road around Belgrade, Obrenovački road and the bypass railway in Ostružnica will be open for public inspection until October 2, and a public hearing is scheduled for October 17 in the City Administration building.

The plan covers an area of ​​30ha, and in the textual part of the elaboration, the purpose of the elaboration is the conversion from the area of ​​public use - forest to areas intended for economic activities, i.e. economic-commercial zone. This area is designated as a forest by the Plan for the General Regulation of Construction Land and the Plan for the General Regulation of the Green Area System. The Law on Planning and Construction prescribes the principle of vertical coordination of plans, i.e. compliance of urban and spatial planning documents so that plans of a lower hierarchical order (PDR) must be harmonized with plans of a higher order (GUP, PGR). In this way, the connection of all levels of spatial and urban planning (and spatial planning), from the national to the regional and then to the local level, is ensured. That is, solutions given by higher-order plans should be elaborated through lower-order plans. Before it goes out for public inspection, each plan undergoes expert control by the planning commission, which includes checking the compliance of the plan in question with plans of a wider area and of a higher order, with the decision on the development of the plan, legal acts, standards and norms, conditions issued by public companies as well as the justification of the planning solution.

How then did the plan, which involves the construction of 314.400 m2 of commercial space in the area where the higher-order plans foresee a forest, receive a positive opinion from the Planning Commission? So that the planning system is meaningless to such an extent that in the Plan for the general regulation of the system of green areas and in the Plan for the general regulation of construction land, within the guidelines for the implementation of the plan, there is a provision that states that during the preparation of the detailed regulation plan, the provisions, conditions and rules set by these plans are considered to be indicative. In other words, the planning solutions foreseen in the detailed regulation plans can be completely arbitrary, made without reference to the wider context, real needs and strategic goals expressed through a series of urban and spatial planning documents and other public policy documents. And such solutions can be adopted, even though they are essentially illegal, precisely thanks to the provisions that define higher order plans as indicative. This opens up space for abuses that lead to long-term negative impacts on the development of the city and the quality of life in it.

Additionally, this area is located in the sanitary protection zone of the water source. In the textual part of the plan, it is stated that economic and commercial activities are planned, which may include manufacturing, transport industry, storage, outdoor sales, hypermarkets, facilities for commercialized sports activities, and amusement parks. On the other hand, in Article 28 of the Rulebook on the method of determining and maintaining sanitary protection zones of water supply sources, it is written that the construction and use of facilities that involve uncontrolled cutting of forests, large gatherings of people, construction and use of sports facilities, as well as catering facilities, storage items from which polluting substances can be released, which roughly excludes all functions that are understood under economic-commercial activities.
